In Minnesota, food and beverages containing limited amounts of Delta 9 THC can be sold in liquor stores, restaurants and other retail locations as a result of laws passed in 2022 and updated in 2023. Minnesota Statute 151 contains testing, labeling and enforcement requirements, and until 2025 some cities have licensing restrictions in place. The bottom line is that if the THC is Delta 9 derived from hemp, and offered in no more than 5 mg per serving (up to 10 mg in a container), it is legal under federal under state law. This regulation is separate from high-potency adult use cannabis that will be sold in dispensaries only. Minnesota will continue allowing consumers widespread access to hemp-derived, low-dose beverages so they can share in the benefits of cannabis.
